Abstract

This article represents an analysis of the regulations in Article 345-A from the Peruvian Civil Code regarding the causal separation of fact, in order to elucidate whether it is compensation for damage or alimony; all this in light of the Third Plenum Casatorio of December 15, 2010 conducted by the Permanent and Transitory Civil Court of the Supreme Court of Justice in and for Peru - Compensation in the Divorce by De Facto Separation - Cassation No. 4664-2010 Puno.
